ARTICLE 1 – ORGANISATION

These Terms and Conditions prevail in the event of any conflict or inconsistency with any other communications, including advertising or promotional materials. Entry/claim instructions are deemed to form part of the Terms and Conditions and by participating all claimants will be deemed to have accepted and be bound by the Terms and Conditions. Please retain a copy for future reference.

Promoter is Bel UK LTD of 160 London Road, Sevenoaks TN13 2JA. Entries to this address will NOT be accepted.

Bel UK LTD, is running a purchase necessary promotion titled ‘GoGo squeeZ and Disney Classics for Back to School’ from 15/08/2022 to 31/10/2022, accessible via Internet (hereinafter the "Promotion").

ARTICLE 2 – TERMS OF PARTICIPATION

The Promotion is open to residents of the United Kingdom aged 18 years or older with the exclusion of members or employees of BEL, its subsidiaries and/or affiliated companies, service providers and/or partners in the organisation of the Promotion, the personnel of the points of sale participating in the implementation of the Promotion, and more generally any person involved in the organisation of the Promotion, as well as their respective parents and allies (hereinafter the “Entrant”).

ARTICLE 3 – PROMOTIONAL PRODUCTS

Eligible promotional products are (the “Promotional Products”):

  • GoGo squeeZ Apple Strawberry 90g x4
  • GoGo squeeZ Apple Mango 90g x4
  • GoGo squeeZ YogurtZ Strawberry 85g x4
  • GoGo squeeZ YogurtZ Peach 85g x4

ARTICLE 4 – CONDITIONS OF PARTICIPATION

  • Entrants must purchase any Promotional Product (retain proof of purchase) between 15/08/22 and 31/10/22, visit winwith.gogosqueez.co.uk, enter their full name, email address and mobile number. Entrants will be required to click on a Disney Character image to find out if they have won an Instant Win prize as detailed in Article 5.
  • All entrants will also be entered into a prize draw at the end of the promotion for a chance to win 1 trip for 4 people to Disneyland Paris. Each time an entrant participates in the instant win they gain an entry into the prize draw. The prize draw will take place within 7 days of the close date of the promotion. The prize draw winner will be notified by e-mail within 3 days of the draw taking place. The prize draw winner will have 14 days to respond to communication via email with their personal details including full name and date of birth. The winner must be over the age of 18.
  • Maximum 1 entry per person, email address and mobile number per day and a maximum of 10 entries per person in total. Maximum one instant win prize per person.

The Promoter reserves the right to verify all entries/ claims including but not limited to asking for address and proof of identity to be sent via email (which they must provide within 14 days) and to refuse to award a prize or withdraw prize entitlement and/or refuse further participation in the promotion and disqualify the participant where there are reasonable grounds to believe there has been a breach of these terms and conditions or any instructions forming part of this promotion’s entry requirements or otherwise where a participant has gained unfair advantage in participating in the promotion or won using fraudulent means. The Promoter will be the final arbiter in any decisions and these will be binding and no correspondence will be entered into in relation to this clause.

    • 4) 100 (One Hundred) Disney Classics Notebooks with a unit value of £4.55 including VAT*;

    • 6) 125 (One Hundred and Twenty Five) Disney Classics Lunchboxes with a unit value of £5.20 including VAT*;
    • 7) 40 (Forty) Disney Classics Metal Water Bottles with a unit value of £6.50 including VAT*;
    • 8) 40 (Forty) Disney Classics Kids Rucksacks with a unit value of £8.25 including VAT*;

    Any entrant who does not win an instant win prize will be able to download a digital gift bundle consisting of the following:

    • The prize includes:
      • Accommodation: 2 nights (two) nights in a standard room for 4 (four) people at Disney's Newport Bay Club Hotel with breakfast included;
      • 3 (three) day tickets for 4 (four) people for Disneyland® Park & Walt Disney Studios® Park
      • 2 (two) day facilitated access to certain rides on Day 1 and Day 3
      • 1 VIP Tour on Day 2
      • Gift vouchers worth €100 to be spent on 30th anniversary merchandise
      • €500 spending money in the form of gift vouchers

The prize excludes all travel requirements (flights, transfers) ;

The prize excludes meals and drinks, excursions, attractions, treatments, car hire, visas and personal expenses and anything not expressly included in the prize;

The trip must take place on one of the proposed dates below :

  • 20/01/2023 – 22/01/2023
  • 24/02/2023 – 26/02/2023
  • 17/03/2023 – 19/03/2023

The winner must choose from one of these travel periods. The travel period cannot be extended or altered.

If the winner cannot take the prize on one of the dates offered above, they will forfeit the prize and the prize will be offered to a reserve winner selected at the same time as the winner.

This prize is non-transferable, non-refundable and cannot be exchanged for cash.

At least one person participating in the trip must be 18 years of age or older.

In Disneyland® Park, height and weight restrictions apply to certain rides/attractions.

ARTICLE 6 – WINNER SELECTION

Instant Win Winner Selection:

Winners will be selected by pre-determined winning moments which have been randomly and securely selected by a computer-generated algorithm with the prizes being equally weighted through the whole promotion period. Those valid entrants (valid entrant being an entrant who has not already won an instant win prize or entered the maximum permitted times) who submit their entry on or first after one of these winning moments time stamps will win a Prize. If no one makes a valid entry within a winning moment timeframe, the available Prize will roll into the next moment or next day of the promotion so that the Prize may still be won i.e., if a winning moment is selected at 23:59 on one day, an entry submitted on 00.01 the next day will capture that winning moment and win a prize if there was no entrant after 23:59. In the event that there are no entries received within a given period between two or more winning moments, the relevant Prize(s) will be rolled forward and awarded to the next available entrant(s). Instant win Prize winners will be directed to a claim page where they will be required to confirm their full name and email address, provide their postal address and upload an image of the original receipt showing purchase of promotional product during the promotional period in order to claim their prize, within 7 days. If any instant win prize winner fails to complete their details, or completes their details but is not eligible for an instant win or they have already won an instant win, they will not receive their prize and the relevant instant win prize will be added to the list of prizes to be allocated at the grand prize draw.

Grand Prize Draw Winner Selection:

The winner(s) of the grand Prize and any unawarded or unclaimed instant win prizes will be selected in a random draw, conducted by an independent adjudicator from all valid entries received within the Promotional Period. The draw will take place within 14 days of the close date of the promotion.

The winner(s) will be informed by email within 3 working days of the Grand Prize Draw and will then have 7 days to respond to that email accepting their prize and providing any reasonable proof of identity. If a winner fails to respond within this time the Promoter reserves the right to offer the prize to another entrant selected at random in the same manner and from the same pool of entrants

ARTICLE 7 – PRIZE DISTRIBUTION

Instant Win Prizes:

Once a winning claim has been validated, all prizes will be dispatched by the Promoter’s handling house to the postal address submitted with their validated winning claim. All prizes will be dispatched after the close date of the promotion to arrive within 28 days of the close date.

It is the responsibility of the claimant to supply the correct postal address. The Promoter will not be liable for non-delivery of a prize caused by the provision of wrong information or other causes beyond the Promoter’s control.

Grand Prize:

The Promoter or its agent will contact the confirmed grand prize winner in November 2022 with the list of available travel dates for the winner to select. The winner will have two weeks to select their choice (subject to availability) and supply their answer. Full details of the prize will be provided to the winner once travel dates have been confirmed.

The prizes are not transferable or exchangeable and cannot be redeemed for cash or any other form of compensation. In the event for any reason the prize winners do not take an element of the prize at the time stipulated by the Promoter, then that element of the prize will be forfeited by the winners and neither cash nor any other form of compensation will be supplied in lieu of that element of the prize. If for any reason a prize is not available, the Promoter reserves the right to substitute another prize for it, in its sole discretion, of equal or higher value if circumstances beyond the Promoter’s control makes it necessary to do so. This includes, as an example, the current COVID-19 outbreak, which may lead to a prize needing to be postponed, changed or rearranged. If prizes cannot be fulfilled, the promoter reserves the right to request a winner choose an alternative prize that can be fulfilled within any applicable COVID-19 rules, regulations or government guidance.

ARTICLE 8 – LIABILITY

The Promoter will do all that it reasonably can to ensure that the Website is functioning correctly throughout the Promotional Period. However, the Promoter will not be responsible for defects or malfunctions in the operation of the Website howsoever caused which affect the operation of the Promotion.

The Promoter shall not be liable for any loss or damage whatsoever which is suffered or sustained as a result of participation in the promotion or redemption or use of the prize. However, this shall not limit or exclude any liability of Promoter or its employees, agents or subcontractors for (a) gross negligence and premeditation, (b) violations of cardinal contractual obligations (i.e. obligations which are essential for achieving the purpose of the contract), (c) damages which are based on injury to life, body or health, (d) guarantees or (e) claims based on product liability laws.

The Promoter does not take responsibility for, recommend or guarantee the performance of any contractual or other obligations of third parties associated with the prize and shall not be liable for any fraud committed by any third party.

By entering the Promotion the entrant agrees that, if they become a prize winner, their surname and county may be published by the Promoter on the Website and via post if requested. They also agree to this information being published on the Promoter’s social media platforms, including Facebook and Twitter and in other media at the Promoter’s sole discretion. If you object to your surname and county being published or made available, please contact the Promoter.

The Promoter reserves the right to disqualify any entrant if it has reasonable grounds to believe the entrant has breached any of the Terms and Conditions. Entry instructions online and in any other marketing materials form part of these Terms and Conditions.

If for any reason any aspect of this promotion is not capable of running as planned, including by reason of infection by computer virus, network failure, bugs, tampering, unauthorised intervention, fraud, technical failures or any other cause beyond the control of the Promoter which corrupts or affects the administration, security, fairness, integrity or proper conduct of this promotion, the Promoter may in its sole discretion modify or suspend the promotion or invalidate any affected entries. If an act, omission, event or circumstance occurs which is beyond the reasonable control of the Promoter and which prevents the Promoter from complying with these terms and conditions the Promoter will not be liable for any failure to perform or delay in performing its obligation.

If any provision or part-provision of these Terms and Conditions is or becomes invalid, illegal or unenforceable, it will be deemed modified to the minimum extent necessary to make it valid, legal and enforceable. If such modification is not possible, the relevant provision or part-provision will be deemed deleted. Any modification to or deletion of a provision or part-provision under this clause will not affect the validity and enforceability of the rest of these Terms and Conditions.

The Promoter’s decision is final and binding in all respects on all entrants. No correspondence will be entered into. Entries that do not comply in full with these terms and conditions will be disqualified. Incomplete entries will be disqualified and will not be entered into the promotion. The Promoter is not obligated to inform the entrants who have entered such entries of such disqualification.

Article 9 – FORCE MAJEURE

“Force Majeure” means the occurrence of an event or circumstance that prevents or impedes BEL from performing one or more of its obligations under the Game, if and to the extent that it proves: [a] that such impediment is beyond its reasonable control; and [b] that it could not reasonably have been foreseen at the time of the initiation of the Game; and [c] that the effects of the impediment could not reasonably have been avoided or overcome by the affected party.

In the absence of proof to the contrary, the following events affecting a party shall be presumed to fulfil conditions (a) and (b) under paragraph 1 of this Clause: (i) war (whether declared or not), hostilities, invasion, act of foreign enemies, extensive military mobilization; (ii) civil war, riot, rebellion and revolution, military or usurped power, insurrection, act of terrorism, sabotage or piracy; (iii) currency and trade restriction, embargo, sanction; (iv) act of authority whether lawful or unlawful, compliance with any law or governmental order, expropriation, seizure of works, requisition, nationalization; (v) plague, pandemic (due to current developments and measures taken globally, nationally and locally in connection with the World Health Organization’s declared public health emergency in respect of the COVID-19 pandemic, BEL activities may be negatively affected, and they commit to make their best efforts to mitigate potential impacts), epidemic, natural disaster or extreme natural event; (vi) explosion, fire, destruction of equipment, prolonged break-down of transport, telecommunication, information system or energy; (vii) general labor disturbance such as boycott, strike and lock-out, go-slow, occupation of factories and premises.

If BEL successfully invokes this Clause, it is relieved from its duty to perform its obligations under the Promotion and from any liability in damages or from any other remedy, from the time at which the impediment causes inability to perform, provided that the notice thereof is given without delay. If notice thereof is not given without delay, the relief is effective from the time at which notice thereof reaches the other party. Where the effect of the impediment or event invoked is temporary, the above consequences shall apply only as long as the impediment invoked impedes performance by BEL. Where the duration of the impediment invoked has the effect of substantially depriving the participants of what they were reasonably entitled to expect under the promotion, BEL has the right to end the Promotion by notification within a reasonable period to the participants. Unless otherwise agreed, the participants expressly agree that the Promotion may be ended by BEL if the duration of the impediment exceeds 120 days.

Article 10 – PERSONAL DATA

The Promoter will collect personal information from the entrant for the purposes of administering this promotion and will share this personal information with its marketing agency who will be supporting the Promoter with the promotion. This includes contacting the winner via email and publicising information as described in Article 8 about the prize winners by post and on the Website. By entering this promotion, entrants agree to the collection and use of their data in this manner. Data will not be used for any other purpose, unless you opt in to receive future communications from the promotor. Your personal data will be retained by the Promoter for 12 weeks after the promotion has ended or until reasonably required for successful validation after which it will be securely destroyed. The Participant has the right to access and rectify their personal data and, insofar as applicable, the right to request the deletion of their data, the right to object to the processing of their data and to obtain the limitation or portability thereof.

Article 11 – GOVERNING LAW – DISPUTES SETTLEMENT

This Promotion is governed by English Law and participants submit to the exclusive jurisdiction of the English courts.
